As a condition of your use of this platform, you warrant that:

AnyDayCharter.com, a service provided by IT Umbrella Corps Ltd (“us”, “we”, or “our”), reserves the right to deny access to this platform and its services. The content and infrastructure of these pages, along with the online boat reservation service, are for your personal, non-commercial use, subject to the terms and conditions outlined below.

The Online Booking Terms and Conditions, effective June 1st, 2024, must be read and understood before confirming your booking. AnyDayCharter.com terms and conditions, subject to occasional updates, govern all services we offer, whether accessed directly or through distributors, across online platforms, mobile devices, email, or telephone. By using our website, applications, or any platform for browsing, accessing, or completing a reservation, you confirm that you have read, understood, and agreed to the terms and conditions outlined, including our privacy and cookies policy.

If this is your first rental experience with AnyDayCharter.com and you intend to rent in a new country, please review the Specific Licensing and Sailing Terms for that country or contact our customer service.

I. Online Booking Procedure

  1. First Step: Selection of the service - Enter the destination and boat type required. Select the boat of choice and check its availability.

  2. Second Step: Based on the given criteria, AnyDayCharter.com will provide you with an offer matching your needs in the form of a detailed recapitulation. The ‘offer’ is legally defined as:

    • A service which includes a selected boat category available for a chosen duration with selected options (if any).

    • A rate which is always prepaid.

  3. Third Step: Acceptance of Offer: Enter all details and confirm that all contact, boat, and date details are correct before proceeding to confirm.

  4. Fourth Step: Confirmation: You will then be asked to confirm this acceptance. It is the user's duty to verify all boat details and extras pricing PRIOR to booking the boat. AnyDayCharter.com will not refund or cancel bookings based on customer 'preference' or the boat not being equipped for what they need.

  5. Fifth Step: AnyDayCharter.com notification; AnyDayCharter.com will send you a final Charter Confirmation with all necessary details.

  6. Sixth Step: Payment stage. Only after payment booking is confirmed can the contract be used as a final confirmation of your charter. Payment is charged accordingly to duly signed contract terms.

II. Confirmation of Booking by AnyDayCharter.com and User Responsibilities

At the end of the booking process, you will be taken to the "Booking Confirmation" page; the booking number will be clearly visible. You will also receive a confirmation email containing the details of your reservation. Please print these and keep them for your records.

User Responsibilities: As a user of AnyDayCharter.com, it's essential to understand your responsibilities to ensure a smooth booking process and enjoyable experience. Please review the following user responsibilities:

  1. Accurate Information: Provide precise and truthful information during the booking process, including personal identification and contact details.

  2. Adherence to Terms: Carefully read and adhere to the terms and conditions outlined by AnyDayCharter.com.

  3. Compliance with Local Regulations: Ensure compliance with all relevant laws, regulations, and licensing requirements at your destination.

  4. Respect for Property: Treat chartered vessels with respect and adhere to safety guidelines.

  5. Timely Communication: Communicate promptly with our customer service team regarding any modifications, cancellations, or concerns before or during the rental period.

  6. Crew List: Crew list must be submitted 1 month prior to your booked charter. AnyDayCharter.com will be in contact with you with further details regarding the submission process. Failure to provide the required information in a timely manner may result in a penalty fine.

III. Reservation Details

Booking Date:

  • We can accept bookings from between 4 days and 12+ months’ notice.

  • We cannot guarantee bookings for the same or following day.

  • In the event that the exact boat requested is not available for the selected dates, AnyDayCharter.com reserves the right to offer alternative options to accommodate your booking needs.

IV. Rates

Your AnyDayCharter.com charter quote takes into account BOAT PRICES ONLY. This quote generally includes the following items:

  • The price of the boat (including discounts and special offers).

  • An excess amount displayed at the time of booking confirmation indicates the maximum amount of money you are liable for in the event of damage to the boat. This excess amount may be waived in some countries by purchasing optional additional protection at the time of booking or arrival. The list of these charges will be made available on the booking confirmation or verified over the phone by an operator.

Additional charges to your basic rental rate may include:

  • Obligatory extras: Local partners may apply mandatory additional charges such as final cleaning and transit log fees to the final boat price.

  • Other options: Skipper, Fuel, Cooks, Hostesses may all incur further charges on top of the booked price.

  • Additional equipment: For further information on additional equipment, you need to contact AnyDayCharter.com directly to confirm pricing.

V. Payment/Means of payment/Deposit Terms and Conditions

A. Payment

  • If your charter date is within 3 days - 30 days: a full payment of booking is usually required. If the charter date is 30 days or more - 50 % of full payment is required and final payment is required 30 days prior to the due date.

B. Means of payment

Payment can be made via the following means of payment:

  • Bank Transfer: AnyDayCharter.com accepts payment in the form of bank transfer, and our account details are provided on the booking confirmation. If payment is made by bank transfer, it is the responsibility of the renter to ensure that the correct amount is transferred (in reference to exchange rates for Euro € prices). The renter also accepts responsibility for payment receipts being forwarded to AnyDayCharter.com and ensures that payment has been received by AnyDayCharter.com.

  • Credit card(s): Credit cards usually accepted within AnyDayCharter.com are "Mastercard" and "Visa". Warning Payment using credit card(s) is (are) accepted in accordance with the limits authorized by your credit card issuer; The credit card holder must be identified as the renter (the "main renter" to be mentioned on the booking agreement) OR needs to have written consent in the form of a third party authorization form for use of another’s credit card. Failure to do so can result in legal proceedings and prosecution

  • PayPal: Valid Paypal account holders can choose to pay the confirmed amount via PayPal. Choosing PayPal as a payment method will result in an additional fee of 3% from the payment amount paid by the customer.

  • Cryptocurrency: AnyDayCharter.com also accepts payment in cryptocurrency. Payment can be made in USDT (Tether) cryptocurrency. Please contact our customer service for further instructions on making payments via cryptocurrency. Choosing cryptocurrency as a payment method will result in an additional fee of 2.5% from the payment amount paid by the customer.

C. Deposit - Transaction Authorization

During the rental:

  • At the time of "Check-int": All transactions beyond the final payment are completed directly with the local supplier - i.e., additional extras to be paid at the base. AnyDayCharter.com bears no responsibility for any errors committed by the local supplier regarding the pricing of extras, transaction errors, and deposit returns.

  • At the time of "Check-out": If the boat is returned without fuel, in an untoward condition, or in a particularly unclean state, the local partner is at liberty to charge additional costs for refueling, repair, or additional cleaning efforts. AnyDayCharter.com accepts no responsibility for any additional costs incurred as a result.

VII. Changes to Reservation: Modification/Cancellation Policy

You can modify or cancel your reservation by email after it is confirmed, provided it is done within 24 hours of the original booking confirmation. To modify or cancel a booking, you need to contact AnyDayCharter.com customer service directly by email. Please note that to modify or cancel the booking confirmation, you must have the booking confirmation ID, name, and details of the renter on the booking agreement.

Available Cancellation Policies:

  • No fees apply within 24 hours.

  • More than 30 days before departure: 50% cancellation fee will be charged (50% of your booking amount will be refunded).

  • 30 days or less before departure: 100% cancellation fee will be charged (no refund).

VIII. Guaranteed Reservation Policy

The AnyDayCharter.com Local Partner is required to provide, within a given "guaranteed period" as defined below, the requested boat as confirmed at the time of booking, subject to the renter meeting rental requirements. In the event the booked boat cannot be provided during this "guaranteed period", AnyDayCharter.com will contact you directly and provide you with the option to book alternative boats that are available. In the event of an accident or boat damage prior to the "guaranteed period", an agreement will be reached with our local partner for a suitable replacement or reimbursement.

Flight/Train delay: If for any reason, the renter is delayed for the booked date, it is the sole responsibility of the renter to inform AnyDayCharter.com and contact the local on-site partner (whom AnyDayCharter.com provides details).

IX. Failure to Collect

Failure to collect your booked boat prior to the closure of the local partner office without notification from the user of delay may result in the booking being cancelled with a full charge. The local partner is also at liberty to allow another booking to proceed the following day.

X. Failure to Return

Failure to return the vessel at the designated ‘check-out’ time will result in extra charges. These extra charges will be indicated and charged by the Local on-site partner. AnyDayCharter.com accepts no responsibility for renters who fail to return the boat at the specified check-out time.

XI. Force Majeure

None of the parties shall be liable for failure in its performance hereunder caused by any case of Force Majeure. "Force Majeure" shall be considered - as defined by the applicable regulation(s) - as any irresistible or unforeseeable event, independent of the party suffering from the case of Force Majeure, which prevents this party from fulfilling its obligations. Legal and/or medical documentation is required by the Renter in cases of "Force Majeure" and will be required by AnyDayCharter.com and the local partner for inspection prior to a ‘credit’ being issued to the renter.

XII. Liability - Applicable Law - Competent Court

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations set out in this article may not apply. In particular, nothing in these terms and conditions will affect the statutory rights of any customer or exclude or restrict any liability for death or personal injury arising from the negligence or fraud of AnyDayCharter.com. You expressly acknowledge and agree that AnyDayCharter.com, its officers, directors, and employees will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to: damages for loss of profits, goodwill, use, data, or other intangible losses (even if AnyDayCharter.com has been advised of the possibility of such damages), resulting from the online booking. These Terms and Conditions have been issued under Republic of Cyprus law.

  3. Fairness and Transparency: We strive to maintain fairness and transparency in our review process. However, we cannot guarantee the accuracy or reliability of user-generated content, and reviews reflect the opinions of the reviewers, not AnyDayCharter.com.

  4. Feedback Consideration: Your feedback is valuable to us and helps us improve our services. While we may take into consideration feedback provided through reviews, we are not obligated to act upon or implement any suggestions or requests made therein.

Any unauthorized use or infringement upon our intellectual property rights constitutes a material violation of our terms and may result in legal action.

XVII. Disclaimer

Subject to the limitations outlined in these terms and conditions and to the extent permitted by applicable law, AnyDayCharter.com shall only be liable for direct damages actually incurred due to a proven failure to fulfill our obligations concerning our services, up to an aggregate amount equivalent to the total cost of your reservation as specified in the confirmation email (whether for one event or a series of connected events).

However, and to the extent permitted by law, neither AnyDayCharter.com nor any of its directors, employees, representatives, subsidiaries, affiliated companies, or others involved in managing the platform and its contents shall be liable for:

(i) Any direct, indirect, consequential, or punitive loss or damages, including but not limited to loss of production, profit, revenue, contract, or goodwill;

(ii) Any inaccuracies in the (descriptive) information, including rental price and availability, of the listings provided on our platform;

(iii) The services or products offered by boat providers or other business partners;

(iv) Any damages, losses, or costs incurred due to the use, inability to use, or delay of our platform;

(v) Any injury, death, property damage, or other damages, losses, or costs incurred due to the acts, errors, breaches, negligence, misconduct, or omissions of service providers or other business partners, including events beyond our control such as cancellation, overbooking, strike, or force majeure.

This disclaimer applies to any (direct, indirect, consequential, or punitive) damages, losses, or costs incurred by you, whether wholly or partly attributable to our service providers or other business partners, including their employees, directors, representatives, or affiliated companies.

XVIII. Cancellation

By completing a reservation on AnyDayCharter.com platform, you acknowledge and agree to abide by the cancellation policy specified by the boat provider, as well as any additional terms and conditions set forth by the boat provider that may pertain to your rental, including services and/or products offered.

The cancellation policy for each rental is accessible on AnyDayCharter.com platform's individual rental page, during the reservation process, and in the confirmation email sent to you. Please be mindful that certain rentals may not be eligible for cancellation or modification. It is recommended to review the rental details for any such conditions before finalizing your reservation. We advise reviewing the cancellation and payment policy of the rental carefully prior to booking and ensuring prompt payment of any outstanding amounts.

Please note that a rental may be cancelled without prior notice if the remaining rental amount cannot be collected on the specified payment date in accordance with the rental's payment policy. Late payments, incorrect bank, debit, or credit card details, invalid cards, or insufficient funds are the responsibility of the renter. Unless otherwise agreed by the boat provider, no refund of the prepaid amount will be provided in such instances.
